Driving Under the Influence or “DUI,” is a very serious crime. Although most DUIS are classified as misdemeanors, the consequences are a lot more serious than most other misdemeanors. DUI can be known by many names. This offense is also known as Driving While Intoxicated (DWI), Drunk Driving, Operating Under the Influence (OUI), Operating While Intoxicated (OWI), and Impaired Driving. Driving Under the Influence (DUI) is not only a serious crime under Tennessee DUI and Arkansas DWI laws, carrying harsh penalties for those convicted of the crime, but DUI cases can be complex due to the many constitutional law issues (including the DUI exception to the constitution) relating to illegal searches and seizures. Further, DUI prosecutions rely heavily on "scientific" tests such as the so-called "Field Sobriety Tests" and other tests (usually blood draws or breath tests) to calculate a person's blood alcohol content (BAC).
