Civil License Suspensions In Wyoming DUI Cases

Wyoming Implied Consent Law:

Under Wyoming DUI law, all drivers who operate motor vehicles in the state are considered to have given their consent to chemical tests of their blood alcohol concentration when police officers request them. The officers must have a good reason to think the driver committed a DUI before asking, and must also inform the driver that refusing to take the test will result in a license suspension of 6 months or 18 months if the driver has ever refused before. The officer must also inform the driver that if the test shows he or she was driving under the influence, his or her license will be suspended for 3 months. The suspension period for underage drivers is 90 days for refusing the test.

If a driver takes a chemical test and the test shows that the driver has a BAC of at least 0.08, his or her license will be suspended for 90 days in addition to any criminal penalties that may eventually be imposed. This 90-day period of suspension counts against the suspension required for a DUI offense conviction.

Wyoming DUI License Suspension Hearings

 

After the driver is arrested, the police officer will issue him or her a temporary license which will expire in 30 days. The driver will then be prohibited from driving unless he or she made a written request for a hearing within 20 days of being arrested. The purpose of the hearing is to determine whether the officer had a good reason to suspect the driver of a DUI offense, whether the driver did refuse the test, and whether the driver was properly informed of the consequences of refusing. If the hearing officer concludes that the driver was properly stopped and informed and did refuse the test, his or her license will be suspended.
