Introduction to the WV Test and Lock program

Any driver who has his or her license suspended for the first time as a result of a conviction for a DUI offense involving alcohol (but not illegal drugs) and those whose licenses were revoked for refusing a chemical test may choose to participate in the Test and Lock program to reduce the term of his or her license suspension. Drivers who were convicted of a DUI with a BAC of 0.15 or more will be required to participate in the program. The driver will be required to attend rehabilitation courses and use an ignition interlock device as follows:

If the person was convicted of a DUI with a BAC of less than 0.15 or of allowing an intoxicated person to drive, the device will be required for 125 days.

If the person was convicted of a DUI with a BAC of more than 0.15, the device will be required for 9 months.

If the driver's license was suspended for refusing a chemical test, the device will be required for 1 year.

If the driver was convicted of a DUI resulting in death, the device will be required for 2 years.

If the driver was convicted of a DUI resulting in injury, the device will be required for 1 year.

If the driver was convicted of underage DUI, the device will be required for 10 months.

West Virginia Ignition Interlock Violation Penalties

Drivers who are required to use an interlock device and drive any vehicle which is not equipped with one are guilty of a misdemeanor which can be punished with between 1 and 6 months in jail and a fine of between $100 and $1000. This does not apply to drivers who operate a vehicle only at their job sites.
