First Offense Utah DUI Penalties
DUI FIRST OFFENSE - CLASS B MISDEMEANOR - FINES: $1,296 - $1,850; JAIL: not less than 48 consecutive hours in jail (which may be substituted with a compensatory-service work program or electronically monitored home confinement) - maximum 6 months; LICENSE SUSPENSION: 90 days; OTHER: mandatory screening and assessment (if necessary), substance abuse treatment or educational series, and probation.
Second Offense UT DUI Punishments
DUI SECOND OFFENSE WITHIN 10 YEARS - FINES: $1,480-$1,850; JAIL: not less than 340 consecutive hours (10 days) in jail (court may substitute with compensatory-service work program or electronically monitored home confinement); LICENSE SUSPENSION: 1 year; OTHER: mandatory screening and assessment (if necessary), substance abuse treatment or educational series, probation.
Third Offense Utah Drunk Driving Consequences
DUI THIRD OFFENSE WITHIN 10 YEARS - THIRD DEGREE FELONY - FINES: $1,500-$2,500; JAIL: up to 5 years in prison; LICENSE SUSPENSION: 1 year; OTHER: screening and assessment; substance abuse treatment and probation. Installation of an ignition interlock device may also be required.
Sentence Enhancements for DUI in Utah
**BAC .16 OR HIGHER/BODILY INJURY/MINOR PASSENGER - In addition to the Utah DUI penalties listed above, the defendant will be required to attend treatment and install an ignition interlock device as a condition of probation. Electronically monitored home confinement may also be required.
