Ignition Interlock Devices in Utah

Utah DUI law provides for the installation of ignition interlock devices under certain circumstances.
What is an ignition interlock device?
An ignition interlock device (IID) is a handheld breath test that attaches to the ignition system of a vehicle.
The IID will prevent a car's ignition from starting unless a sober breath sample is first blown into the device. Additional random breath samples will also be required periodically while the vehicle is in motion.
When is an ignition interlock device required under Utah DUI law?
In Utah DUI cases, Ignition interlock devices must be installed on every vehicle the DUI defendant owns and operates. The cost of the device including installation as well as the monthly payments must be paid by the defendant. Defendants who operate vehicles owned by their employers in the scope of their employment may operate vehicles without an IID device if the court grants permission to do so. In such situations the offender is required to notify the employer of the IID requirement and keep a copy of the signed notification in the vehicle at all times.
Utah DUI offenders required to install an IID that are caught operating a vehicle without a device will be charged with a class B misdemeanor. Attempts to tamper or circumvent the device will also result in the imposition of further penalties. All breath sample readings are recording in the device and transmitted to the proper authorities. Persons who are caught operating or attempting to operate a vehicle with a BAC over a certain limit (typically .02) will also risk further punishment.
