Driving Under the Influence In South Dakota:
There are 3 ways to commit a DUI in South Dakota.
First, anyone who drives with a BAC of at least 0.08 is guilty of a DUI.
Second, anyone who drives under the influence of alcohol, an illegal drug, or a legal drug used improperly is guilty of a DUI.
Third, anyone who drives impaired by a legal substance or the combined effects of a legal substance with alcohol to the extent that he or she cannot safely operate a vehicle is guilty of a DUI.

Driver Under 21 Operating After Consumption
Under South Dakota DUI Law, if a driver under age 21 has either a BAC of at least 0.02 or any detectable amount of an illegal drug in their system, he or she is guilty of Operating a Motor Vehicle after Consuming Drugs or Alcohol.
