Oregon DUII and Out Of State Drivers

What happens if you live in another state and get a DUII in Oregon

If you are arrested for DUII in Oregon, but live elsewhere (and you license is not from Oregon), you may wonder whether you will receive a license suspension in your home state as a result of your Oregon DUI case.

Oregon lacks the authority to directly suspend a license from anywhere other than Oregon. Along with most other states, Oregon participates in the Interstate Motor Vehicle Compact, which provides a mechanism for states to share information about licensed drivers with each other.

It is impossible to list all of the states that, in combination with an Oregon DUII suspension will or will not suspend your license, so it is critical that you have an Oregon DUII attorney who understands the interplay of the Motor Vehicle Compact between Oregon and your state, or who at least can query reliable lawyers in your home state to predict what may happen and take steps to minimize the impact on you.

If the state where you are licensed learns of the charge, suspension or conviction for DUII in Oregon, they may immediately suspend your license. Most states will send you notice in the mail, so make sure that your mailing address is up to date with the DMV in your state. The notice may or may not provide you with an opportunity to request a hearing.
