Oregon DUI Penalties
The following outlines the minimum penalty guidelines dictated by Oregon DUII law. Although there are mandatory minimum penalties you could receive significantly more than the minimum. Factors that are considered when determining your sentence include:
- Your DUI and criminal History.
- Your alcohol level.
- Your attitude during the process (were you cooperative, belligerent, or somewhere in between).
- Whether there was an accident with or without injuries.
- Whether you placed others in jeopardy by having passengers in your car (children carry substantially more weight in this regard towards enhanced penalties).
- Whether the court perceives that you are remorseful (getting an alcohol evaluation, doing treatment and/or attending AA meetings before you are ordered to do so can help in this regard).
The local customs of the court you are in, as well as the mindset of the individual judge who will ultimately determine your sentence are also factors, but are difficult to quantify. Therefore, it is extremely important to have a lawyer who is familiar with the local courts and judges.

First Offense Oregon DUII Penalties:
Jail: Minimum jail sentence of 2 days. Maximum jail sentence is one year. Alternatives to jail such as electronic home detention, work crew or release or community service may be available.
Fines: Minimum of $1,000 in fines plus costs and fees.
License Suspension: A one-year suspension.
Treatment and Education: Mandatory participation in alcohol treatment or education classes.
Other: Attend a DUI victim impact panel.
Second Offense Oregon DUII Penalties:
Jail: Minimum jail sentence of 2 days. Maximum jail sentence is one year. Alternatives to jail such as electronic home detention, work crew or release or community service may be available.
Fines: Minimum of $1500 in fines plus costs and fees.
License Suspension: A one-year suspension.
Treatment and Education: Mandatory participation in alcohol treatment or education classes.
Other: Attend a DUI victim impact panel.
Third Offense Oregon DUII Penalties:
Jail: Minimum jail sentence of 2 days. Maximum jail sentence is one year. Alternatives to jail such as electronic home detention, work crew or release or community service may be available.
Fines: Minimum of $2000 in fines (if the person is not sentenced to a term of imprisonment) plus costs and fees.
License Suspension: Lifetime license suspension.
Treatment and Education: Mandatory participation in alcohol treatment or education classes.
Other: Attend a DUI victim impact panel.
Oregon Felony DUI Penalties:
Jail: Prison sentence of 13 months to 5 years.
Fines: Minimum of $2000 in fines.
License Suspension: Lifetime license suspension.
