Oklahoma Ignition Interlock Device Law
In some circumstances, drivers who wish to restore their driving privileges after being convicted of a DUI will be required to use an ignition interlock device.
In Oklahoma, if a person is required to use an interlock device, they must pay to have it installed in every vehicle registered to them, leased by them, or operated by them.
Employer owned vehicle exception to the ignition interlock device in Oklahoma DUI cases.
If the driver's employer provides them a vehicle for work purposes and the driver is not self-employed or employed by a close relative, the employer may choose not to install the device in the vehicle. If the employer does not wish to install the device, he or she must provide written notice to the licensing department and give the driver a signed letter stating that the employer has given permission for the employee to operate the vehicle without the interlock device. The driver must carry this letter at all times that he or she is operating the vehicle and show it to any police officer upon request.
In Oklahoma DUI cases, and interlock device is required in 2 situations.
First, if the driver's license to drive was suspended because they committed at least 2 DUI offenses within 5 years, the driver must use the device for 6 months.
Second, if the driver is classified as an "excessive user" of alcohol or other intoxicating substances by the licensing department, the driver must use the device for 1 year.
Penalty for bypassing an Ignition Interlock Device in Oklahoma
If a driver is required to use an ignition interlock device, it is illegal for him or her to attempt to bypass the device either by getting another person to activate the vehicle or by physically tampering with the device. This can be punished with a fine of up to $500 and a jail sentence of up to 6 months.
