Under Oklahoma DUI Law, it is illegal to drive or physically control a vehicle if you are under the influence of alcohol or drugs, or impaired by them.

The legal limit for alcohol is 0.08 percent alcohol content. This means that if you were that high, the state will not have to prove that you were impaired because everything at that level or above in Oklahoma is presumed by the law to be impaired.

Oklahoma also has separate laws for driving under the influence in commercial vehicles (legal limit of 0.04), and for people under 21 years old (legal limit of 0.02).

Oklahoma DUI laws provide for gradually stiffer criminal penalties. A first offense carries a jail sentence of between one day and one year in jail. A second offense in 10 years carries between 1 and 5 years in prison, but the court can reduce the jail time to 5 days. A third offense carries between 1 and 7 years in prison, and can be reduced to a minimum of 10 days. A fourth offense or greater carries between 1 and 10 years in prison, and a judge could reduce the time to serve to as little as 10 days.

In addition to the jail time, there are stiff fines and license revocations that are associated with every OK criminal drunk driving conviction. If you are convicted of aggravated DUI, you will be required to submit to a minimum of one year of alcohol testing and monitoring, 480 hours of community service, and have an ignition interlock device.
