Violations of Ohio's DUI statute are charged as first degree misdemeanors. The penalties for a criminal DUI charge in Ohio are listed below. Minimum jail time is 3 consecutive days (72 consecutive hours) or 3 consecutive days of a driver's intervention program. If high test result or refusal, 6 days minimum jail time or 3 days + Alcohol Education/Intervention Program. $200 - $1,000 in fines. Court license suspension of 6 months - 3 years (Class 5 suspension). Court may grant permit in certain circumstances.
Second Offense: 10 days mandatory minimum jail time. If high test result or refusal, minimum mandatory 20 days. $525 - $1,625 in fines. Court ordered license suspension of 1 - 5 years. Mandatory installation of yellow license plates on vehicle. 90 day vehicle immobilization.
Third Offense: 30 days mandatory minimum jail time. If high test result or refusal, 60 days minimum jail time. $850 - $2,750 in fines. Court License Suspension of 2 - 10 years. Mandatory DUI yellow plates and Ignition Interlock Device installation. Mandatory vehicle forfeiture. Fourth + Offense: 60 days - 1 year imprisonment. If high test result or refusal, 120 day jail time - 1 year. $800 - $10,000 in fines. Court License Suspension of 3 years - life. Mandatory yellow DUI plates and vehicle immobilization and forfeiture.
