A 36-year-old Lexington resident was found guilty on all three counts he faced in a DUI death case stemming from a 2007 accident.

Herchel Huff was officially charged with tampering with a witness, refusal to submit a chemical test and motor vehicle homicide. Huff was charged in connection with an October 3, 2007, accident where he allegedly stuck and killed 28-year-old Kaser Warner while she was running with her 3-year-old daughter.

Huff's defense strategy was to maintain he only had a few drinks that day over an extended period of time. To testify in Huff's defense, a witness from the bar where Huff had been drinking testified to this face. She said he consumed approximately two beers in many hours. Her testimony, though, was called to question because she told jurors Huff's companion had not been drinking. In a voluntary breath test that day, the passenger had registered a .21%.

Huff cried on the stand but also admitted he had never apologized to the families of the victim. Huff's recounting of the accident was also somewhat sparse, according to Lexch.com, either from the lapse of time between the event and the trial or other factors. The jury rendered a verdict in about two hours but was not sympathetic to Huff's account of the events. He will be sentenced for the crime on May 5.
