Cook County State Attorney Anita Alvarez announced there will be no official criminal charges against Chicago Police Officer Richard Fiorito despite testimony he targeted the gay population for false DUI arrests.

Fiorito has been under investigation for about a year due to the phony DUI charges. The suspects in the DUI cases provided dash-cam evidence to show they were not properly arrested, claiming Fiorito falsified arrest reports to say they were driving erratically when they were not. In particular, the suspects say they were targeted after leaving gay bars in Chicago's Boystown.

While a civil lawsuit is still continuing, Fiorito will not face any jail time. He was already relieved of his duty in an internal investigation and is no longer making arrests. In part, the case was not pursued due to what Dan Kirk, chief of staff for the State Attorney, called "credibility issues" with the witnesses. (ABC7) There were inconsistencies in testimony that may not stand up in a criminal court.
