According the a USA Today and AP report, film star Wesley Snipes is appealing his conviction on federal tax evasion charges. Snipes was convicted and sentenced in April of 2008 after a high-profile trial in which he was accused of refusing to pay nearly $3-million in owed taxes.

Since the conviction, Snipes has been out of custody on bail, as his appeal is pending.

The issues raised on appeal by his attorneys include an allegation that the judge's refusal to change venue compromised the case and that the three year sentence was too harsh given the facts of the case. Many people feel that Snipes is being used as an example to deter other would-be tax evaders.

Any person convicted of a crime enjoys the right to appeal. It is up to the lawyers at the trial level to make a record that will be used in an eventual appeal. In a high profile case like this, an appeal is almost a certainty following a conviction. One notable exception was the conviction of Martha Stewart. Ms. Stewart decided to get her prison sentence out of the way so she could move on with her life.

In lower profile cases, many defendants who are wrongfully convicted or unjustly sentenced choose not to appeal because of the long-term stress and financial hardship it would cause.

Why put a man any man in jail for not paying taxes. Our jails are so over crowded now with violent criminals. It makes no sense to put anyone in jail for failing to file a tax return. Even if he was trying to beat the system. Who of us don't try to take every tax break or deduction we can. A fine penalties and community service. Makes more sense than putting anyone in jail for a non violent crime. I am a fan of most of wesley snipes motion pictures, but i' m not necessarily a fan of his politics or personal beliefs, what ever they may be. Putting Martha white in jail was not what I would have done either. But if you think I'm soft on crime, don't be. Cause I'm a retired policeman and am pro do the crime do the time. He's going to jail for REFUSING to pay his taxes.

So he made a mistake, so what we all do, I don't like the fact that there trying to make such an example of him. There are so many people who they could of done that with. Martha stewart was treating like a queen. I know many people who don't file for taxes for 2-3yrs then go back and file and pay the fines. Many Dr's do it. SO why is he any different. People in the oval office did it. Let him pay what he owes and any fines and let him get on with his life.

Why would any Goverment put any one in jail for not fileing a tax return when a reminder would do. such a great actor with a moveing history. let the man make his films and make us all grip our seats.all the best Wesley Snipes.
