A 19-year-old Portsmouth man accused of felony DWI resulting from a June 13 accident was apprehended while out on bail for multiple violations.

The Rockingham County Attorney's Office will ask a judge to revoke Mercer Smith's bail in a hearing to be held this Monday at 9AM. Smith was originally arrested for crashing an SUV into a local sports shop, causing over $1,000 in damage and injuring himself and two passengers the night of his high school graduation.

He was 18 the night the accident occurred just after 2:30 AM. A blood test performed at a local medical center confirmed there was alcohol in his system. The other passengers in the car were thought to be drinking as well.

Smith was out on $1,000 cash bail when he was arrested in Durham for charges of drug possession, resisting arrest and littering. The county attorney says Smith was instructed to be on good behavior and avoid alcohol and drugs during his bail.

Smith faces 5 separate charges resulting from the June crash. He is charged with 3 counts felony DWI, 1 count aggravated DWI and 1 count criminal mischief. The criminal mischief charge is equivalent to vandalism charges due to the damage he did to the local store's facade.
