Police officer found defendant Sarah Frances Hindsley and her passenger asleep in their vehicle on Highway 169 around 8AM Sunday morning. As he approached the sleeping driver, he smelled alcohol and immediately suspected DUI.
The officer opened the unlocked door and woke up the driver. She could not provide the officer with her name. This lead to a search of her bag for proper identification and insurance information. The search did not yield answers.
The officer allowed Hindsley to hang on his arm for stability while he escorted her to a squad car. A second officer arrived to search the vehicle. He found a marijuana pipe and an open container of alcohol, most of its contents gone.
The driver failed field sobriety tests and registered a .196% BAC on preliminary breath tests. Hindsley asked to place a phone call to an attorney. She called her mother when officers fulfilled the request.
Officers determined the breath test machine was faulty, which has become a regular problem with these devices. They requested a blood test, but Hindsley feared this would reveal other substances she had consumed. She submitted a blood test anyway. The police report did not contain information regarding whether the woman requested a sample be held for her to give to an independent lab.
When Hindsley was booked, officers discovered she was driving on a revoked license. She had three impaired driving incidents in 200, 2001 and 2003. The woman has been charged with first degree driving while impaired and she could be sentenced to up to seven years in jail.
The sentencing will be aggravated due to charges for driving with a revoked license, an open container, and possession of paraphernalia. Bail is set at $50,000. Hindsely currently remains in jail.
