New York DWI License Suspension Hearings

If your license has been suspended in a New York DWI Case after refusing to submit or failing a chemical test, you can request a hearing with the department of motor vehicles to challenge your suspension.  Once requested, the hearing must be held within 15 days. Until the hearing occurs, your DWI citation will act as your temporary driver's license.  Failure to request a hearing will result in an automatic approval of your license suspension.

At the hearing, a hearing officer will determine the follow issues: 
whether the police had reasonable grounds to believe you were driving under the influence; whether your arrest was lawful; whether you were properly informed of you implied consent rights and consequences of your refusal; and whether you did refuse to submit to a chemical test.

If any of the above issues are answered in the negative, your license suspension will be terminated and your driving privileges will be fully reinstated.
