The penalties that are imposed upon a criminal DWI conviction in the state of New Hampshire are listed below. In addition to the license suspension that may be ordered by the court upon a criminal conviction, an additional administrative license suspension may also apply. FIRST OFFENSE DWI - CLASS B MISDEMEANOR - FINES: $500 - $1,200; LICENSE SUSPENSION: 90 days - 2 years (6 months may be suspended if enroll in impaired driver intervention program (I.D.I.P.) within 45 days of conviction); OTHER: SR-22 insurance for 3 years
FIRST OFFENSE AGGREVATED DWI - CLASS A MISDEMEANOR - FINES: $750 - $2,000; JAIL: minimum 10 days (3 days county house of corrections and 7 days at multiple DWI offender intervention center) - maximum 1 year; LICENSE SUSPENSION: 18 months - 2 years; OTHER: SR-22 insurance for 3 years
SECOND OFFENSE DWI WITHIN 2-10 YEARS - FINES: $750 - $2,000; JAIL: minimum 10 days (3 days in county house of corrections and 7 days in multiple DWI offender intervention detention center) - up to 12 months; LICENSE SUSPENSION: 3 years; OTHER: SR-22 insurance for 3 years and possible ignition interlock
SECOND OFFENSE DWI WITHIN 2 YEARS - FINES: $750 - $2,000; JAIL: 30 days in county house of corrections followed by 7 days in mutiple DWI offender intervention detention center - up to 12 months; LICENSE SUSPENSION: 3 years; OTHER: SR-22 insurance and possible ignition interlock
THIRD OFFENSE DWI WITHIN 10 YEARS - FINES: $750 - $2,000; JAIL: not less than 180 days [30 days in county house of corrections (Up to 5 months may be deferred by court if driver completes a 28 day residential inpatient program)] - maximum 12 months; LICENSE SUSPENSION: indefinite license suspension period (at least 5 years); OTHER: SR-22 insurance and possible ignition interlock
DWI SERIOUS BODILY INJURY - FELONY - mandatory minimum 14 day jail sentence + 7 days in multiple offender intervention detention center
FOURTH OFFENSE DWI - FELONY - minimum 30 days - up to 7 years in state prison + 28 day residential treatment program; LICENSE SUSPENSION: indefinite license suspension (at least 7 years).
