Montana Ignition Interlock Laws

An Ignition Interlock Device (IID) is a handheld breath testing devices that attaches to the ignition system of a car. The device prevents the vehicle from starting unless a breath sample under a prescribed limit (typically .02) is blown into the device. The IID device will be required to be installed on all vehicles a DUI offender owns and operates on a regular basis. Random breath samples will also be required periodically while the car is in motion to prevent a sober friend from starting the vehicle.

When a person will have to have an ignition interlock device in Montana

In Montana, persons convicted of a first offense DUI may be restricted by the court to driving a motor vehicle that only has been equipped with a functioning ignition interlock device during their probationary period. Persons convicted of a second or subsequent DUI offense may also be required to install an IID during the 1 year period following the end of any license suspension period. DUI offenders are responsible for paying the reasonable cost of leasing, installing and maintaining the device.

What are the penalties for not having an interlock or tampering with it in Montana?

Montana law makes it unlawful for a person who is required to install an IID device to operate a vehicle that is not equipped with such a device. It is also unlawful for any person to knowingly assist a person required to install an IID to start and operate the restricted vehicle. Any attempt to circumvent or tamper with the IID is unlawful. The punishments for such offenses include a fine up to $500 and 6 months in jail.
