Michigan DUI Penalties
Listed below are the criminal penalties for Michigan DUI cases. FIRST OFFENSE OWI/OWVI - FINES: $100-$500; JAIL: Up to 93 days in jail; LICENSE SUSPENSION: 30 day suspension followed by 150 days of restricted driving privileges; OTHER: Up to 360 hours of community service, possible order for installation of an Ignition Interlock Device, vehicle immobilization (discretionary).
SECOND OFFENSE OWI/OWVI WITHIN 7 YEARS - FINES: $200-$1,000; JAIL: 5 days - 1 year in jail; LICENSE SUSPENSION: 1 year; OTHER: mandatory 30-90 days community service, possible order for installation of ignition interlock device, confiscation of license plate, mandatory vehicle forfeiture/immobilization for 90-180 days.
THIRD OFFENSE OWI/OWVI - FINES: $500-$5,000; JAIL: 1-5 years in jail; LICENSE SUSPENSION: 5 year minimum suspension; OTHER: Mandatory 60-180 day community service, license plate confiscation, mandatory vehicle forfeiture/immobilization for 1-3 years, possible order for installation of ignition interlock device.
ALLOWING A PERSON TO OWI/OWVI - FINES: $100-$500, JAIL: up to 93 days.
ALLOWING A PERSON TO OWI/OVWI THAT CAUSES A DEATH - FINES: $1,500-$10,000; JAIL: up to 5 years in prison.
ALLOWING A PERSON TO OWI/OVWI THAT CAUSES SERIOUS INJURY - FINES: $100-$5,000; JAIL: up to 2 years.
OWI CAUSING DEATH - FINES: $2,500-$10,000; JAIL: up to 15 years in prison; OTHER: mandatory vehicle immobilization.
OWI CAUSING DEATH TO POLICE/FIREMAN - FINES: $2,500-$10,000; JAIL: up to 20 years in prison; OTHER: mandatory vehicle immobilization.
