Mass OUI LawsIn Massachusetts, drunk driving charges may be referred to as "DUI" (Driving Under the Influence), or "OUI" (Operating Under the Influence).

Massachusetts DUI Law Basics

Under Massachusetts DUI law, it is illegal to operate a motor vehicle while under the influence of alcohol, marijuana, narcotic drugs, depressants or stimulants.  Massachusetts also has a "per se" portion of the DUI law that makes it illegal to operate a motor vehicle with a Blood Alcohol Level (BAC) .08 or higher.

Commercial Vehicles: Drivers of commercial vehicles are considered DUI when their BAC is .04 or higher.  In addition to the DUI penalties, Commercial drivers also face loss of their license for a period of one year, or three years if they were transporting hazardous materials at the time of their arrest.

Under 21: Minors under the age of 21 are not permitted to operate a motor vehicle with a BAC of .02 or higher.

Child Endangerment: Any person who is arrested for DUI in Massachusetts who was driving with a minor under the age of 14 in the car will also be charge with child endangerment.

Serious Bodily Injury: A DUI suspect who has caused an accident resulting in serious bodily injury will face more serious consequences.  In Massachusetts, "serious bodily injury" is defined as bodily injury that creates a substantial risk of death or which involves total disability or the loss or impairment of some bodily function for a substantial time.
