Maine OUI Penalties - ME DUI Punishments

FIRST OFFENSE OUI - FINES: not less than $500; JAIL: not less than 48 hours if BAC was .15 or higher, was speeding 30 mph over the speed limit, eluded or attempted to elude an officer, or was operating with a passenger under the age of 21; LICENSE SUSPENSION: 90 days; OTHER: possible alcohol/drug treatment

FIRST OFFENSE OUI - CHEMICAL TEST REFUSAL - FINES: not less than $600; JAIL: Not less than 96 hours

SECOND OFFENSE OUI WITHIN 10 YEARS - FINES: not less than $700; JAIL: not less than 7 days; LICENSE SUSPENSION: 3 years (may be lowered to 9 months with installation of ignition interlock device); OTHER: court ordered suspension of right to register a vehicle; OTHER: possible alcohol/drug treatment

SECOND OFFENSE OUI WITHIN 10 YEARS - CHEMICAL TEST REFUSAL - FINES: not less than $900; JAIL: not less than 12 days;

THIRD OFFENSE OUI WITHIN 10 YEARS - FINES: not less than $1,100; JAIL: not less than 30 days; LICENSE SUSPENSION: 6 years (3 years if offender installs an ignition interlock device); OTHER: court ordered suspension of right to register a vehicle, and possible alcohol/drug treatment

THIRD OFFENSE OUI WITHIN 10 YEARS - CHEMICAL TEST REFUSAL - FINES: not less than $1,400; JAIL: not less than 40 days

FOURTH OR SUBSEQUENT OFFENSE OUI WITHIN 10 YEARS - FINES: not less than $2,100; JAIL: not less than 6 months; LICENSE SUSPENSION: 6 years; OTHER: court ordered suspension of right to register a vehicle, and installation of an ignition interlock device in the vehicle the person operates for a period of 4 years after the period of suspension has run, possible alcohol/drug treatment

FOURTH OR SUBSEQUENT OFFENSE OUI WITHIN 10 YEARS - CHEMICAL TEST REFUSAL - FINES: not less than $2,500; JAIL: not less than 6 months and 20 days

SIXTH OFFENSE OUI - CLASS B FELONY - FINES: not less than $3,000 ($3,500 if refusal); JAIL: minimum 1 year in prison - maximum 10 years; LICENSE SUSPENSION: lifetime license revocation without any work permit eligibility; OTHER: suspension of right to register a vehicle

OUI DEATH - FINES: $20,000; JAIL: up to 20 years in prison; LICENSE SUSPENSION: lifetime license revocation

OUI SERIOUS BODILY INJURY - CLASS B FELONY - FINES: not less than $2,100; JAIL: minimum 6 months - maximum 10 years; LICENSE SUSPENSION: 10 year suspension without eligibility for work permit; OTHER: suspension of right to register a vehicle

**Persons who had a passenger under the age of 21 present at the time of the offense will be given an additional 275 day license suspension.
