Certified  Intoxilyzer Operator Intoxilyzer Operator: In 2004 Wayne completed the requirements set by the US Department of Transportation needed to become a certified operator of the Intoxilyzer 5000 breath test machine. The Intoxilyzer 5000 is the breath testing machine used in Maine DUI cases. Understanding the Intoxilyzer 5000 is absolutely necessary to defend most Maine DUI’s.

Mr. Foote knows that, as a DUI defense lawyer, he is the only person that stands between his clients and a conviction (and all the serious consequences that go with a conviction). He takes this great responsibility extremely seriously.

When Wayne is not in the courtroom, he is constantly expanding and sharpening his knowledge and skills when it comes to OUI defense. He devotes 100 percent of his practice to criminal defense, of which about 80 percent of his cases are typically OUI related.

Wayne is the only lawyer in Maine who is certified by the National College for DUI Defense, an honor not given out lightly. In fact, there are fewer than 40 Board Certified DUI Defense lawyers in the whole country. Many lawyers who apply for certification either don't qualify because they lack experience, or they are unable to pass the stringent examination.

Attorney Foote understands that your job and your freedom are at stake, and that the outcome of your case could brand you as a "criminal." That is why he takes 20 to 25 cases to trial each year. He fights for each of his clients. By his estimates he is very successful in trial, having won between 60 and 65 percent of his jury trials, and between 75 and 80 percent of trials directly to a judge. His willingness to fight, his preparation, courtroom skills and knowledge of DUI defense make prosecutors and judges take him seriously, and give him and his clients due respect during the litigation and negotiation process.

College and Law School: Mr. Foote is 1983 magna cum laude graduate of Colby College in Waterville, Maine, with a degree in history. He was elected to the Phi Beta Kappa honor society and was awarded the 1983 Wilkinson Prize in history. He graduated from the University of Maine School of Law in 1986.

Bar Admissions: Mr. Foote is admitted to practice law throughout the State of Maine, in the United States District Court for the District of Maine, the Passamaquoddy Tribal Court, the United States Court of Appeals for the First Circuit, and the United States Supreme Court.

OUI Training: He has received Certificates of Achievement for successful completion of the National College for DUI Defense, Inc.'s Summer Sessions in 1998, 1999, 2000, 2001, 2003, 2005, 2006 and 2008, Mastering Scientific Evidence in DUI/DWI Cases in 2002 and 2005, Florida International University’s Breath Analysis Forensic Workshop in 2004, and National Association of Criminal Defense Lawyers’ DWI training session in 2005. Mr. Foote also successfully completed training to USDOT standards as a Maintenance Technician and Operator for the Intoxilyzer 5000. He successfully completed the rigorous Blood and Urine Testing school in San Diego in 2009. In 2007, Mr. Foote became the first and only attorney in Maine who is Board Certified in DUI Defense Law by the National College for DUI Defense, Inc. Teaching and Memberships: Wayne is a sustaining member of the National College for DUI Defense and Maine's only Board Certified OUI Defense Specialist. He is a Charter Member, past Vice President and a curent Director of the Maine Association of Criminal Defense Lawyers. Attorney Foote teaches continuing legal education seminars to other lawyers on the subject of drunk driving law and criminal defense both in Maine and nationally. He has lectured in graduate level courses at the University of Maine.

Publications: Mr. Foote’s article, “In and Out of Canada,” detailing the problems a DUI conviction can have on travel to Canada was published in the NCDD Journal, Vol. 1, Issue 12 (Spring 2010).

Military Service: Born in 1950 in Massachusetts, he served 8 years in the United States Army as an electronic intelligence specialist and Russian linguist. After serving his country for 8 years and achieving the rank of Staff Sergeant, he received an honorable discharge.
