INDIANA IGNITION INTERLOCK LAW

An ignition interlock device (IID) is a handheld breath testing device that attaches to the ignition system of a motor vehicle. Persons required to install the device must blow a breath sample under .02 in order to start the vehicle's ignition. Additional random breath samples will also be required while the car is in motion to prevent a sober friend from starting the vehicle. Any person who knowingly starts a motor vehicle for a DUI offender is guilty of a Class A misdemeanor offense. Failure to provide a breath sample, or a sample that produces a result over .02 will render the car inoperable.

Persons required to install an IID are prohibited from operating a motor vehicle without a functioning certified ignition interlock device for the duration of their probation period. Failure to comply with this restriction is a Class B misdemanor offense. Attempts to tamper, circumvent or render an IID inaccuracte or inoperative is also a Class B misdmeanor. The term for which an IID is required by the court may not exceed the maximum term of imprisonment the court could have imposed. Indiana OWI offenders are responsible for all costs associated with installation of the device unless determined indigent by the sentencing court.

Persons who refuse to submit to chemical testing may petition the court to stay their license suspension in exchange for restricted driving privileges with installation of an IID.
