Illinois DUI Penalties and Punishments

The time of your suspension ranges from 6 to 12 months, depending on if you refused the test and whether your BAC level was lower than .08%. When convicted, the court can impose jail time up to 364 days and assess fees of up to $2500. If your BAC is above .016%, the court assesses a minimal additional $500 fine along with 100 community service hours. 

If you operate a vehicle while under the influence and are driving with a child younger than 16, convictions result in a minimal, additional $500 fine, 100 community service hours, and six months additional jail time. If bodily injury occurs while driving with the child, you face felony charges. If convicted, sentencing ranges from 1-3 years and you can be assessed $25,000 in fees and twenty-five days of community service. 

Any positive BAC reading results in a 3-12 month license suspension for drivers who are under 21. If you refuse the test, suspension ranges from 6-24 months. Convictions result in a two year license revocation. Subsequent convictions for adults and drivers under 21 have more stringent sentencing, longer revocation periods, and additional fines.
