Blood and Breath Testing In Illinois DUI Cases

The DUI statute that gives Illinois the right to automatically suspend your license if you have .08% or higher blood alcohol level, provides for a longer suspension if you refuse to submit to a chemical blood alcohol test. Illinois takes the position that drivers implicitly consent to the test by using the state’s roads.
