Georgia DUI Penalties

The following penalties listed below are a general guide of what to expect in the criminal aspect of your DUI case. For more information on the civil penalties you may face, check out the Georgia driving tab.


Georgia DUI FIRST OFFENSE


FINES: $300 - $1,000

JAIL: 10 days - 1 year (judge has discretion to stay, suspend, or probate the jail time). If BAC is .08 or higher, mandatory minimum of 24 hours in jail

COMMUNITY SERVICE: 20 hours if BAC under .08, 40 hours if BAC is higher than .08

DRIVERS LICENSE SUSPENSION: 1 year suspension if over the age of 21 (may get work permit for first 120 days, and full reinstatement of license after 120 days if all probation requirements are complete), 6 months suspension if under the age of 21 and BAC is under .08, or 1 year if BAC is higher than .08 (no permits)

OTHER: Mandatory Drug Alcohol or Drug Use Risk Reduction Program, clinical evaluation and 1 year probation less any time spent in jail

 


Gerogia DUI SECOND OFFENSE WITHIN 10 YEARS


FINES: $600 - $1,000

JAIL: 90 days - 1 year, mandatory minimum 72 hours in jail

COMMUNITY SERVICE: at least 30 days

LICENSE SUSPENSION: 3 year suspension (one year hard suspension then 6 month work permit with proof of ignition interlock; eligible for full reinstatement after work permit if no violations)

OTHER: Mandatory Drug Alcohol or Drug Use Risk Reduction Program, clinical evaluation and 1 year probation less any time spent in jail, $25 newspaper publication fee in county of residence

 


GEORGIA DUI THIRD OFFENSE WITHIN 10 YEARS

FINES: $1,000 - $5,000

JAIL: 120 days - 1 year, mandatroy minimum 15 days

COMMUNITY SERVICE: at least 30 days

LICENSE SUSPENSION: 5 year revocation (two year hard suspension, then ignition interlock permit for six months and reinstatement of a probationary license if DUI school, clinical evaluation, and seventeen weeks of treatment is completed; full reinstatement after five years)

OTHER: Mandatory Drug Alcohol or Drug Use Risk Reduction Program, clinical evaluation and 1 year probation less any time spent in jail, $25 publication fee for newspaper ad in the county of residence, and mandatory surrender of license plates in any car in offender's name.

 


GEORGIA DUI FOURTH OR SUBSEQUENT OFFENSE WITHIN 10 YEARS

FINES: $1,000 - $5,000

JAIL: 1 - 5 years, mandatory minimum 90 days in jail

COMMUNITY SERVICE: at least 60 days (judge may suspend if jail time is 3 years)

LICENSE SUSPENSION: 5 year suspension as habitual offender

OTHER: Mandatory Drug Alcohol or Drug Use Risk Reduction Program, clinical evaluation and 5 years probation less any days spent in jail, $25 publication fee for newspaper ad in the county of residence, and mandatory surrender of license plates in any car in offender's name.
