Ignition Interlock Devices in Connecticut DUI Cases

An ignition interlock device (IID) is a handheld breath testing device that requires a driver to blow a breath sample into the device prior to starting the vehicle. If the person's BAC is higher than .025, the vehicle will not be started. Periodic breath samples will also randomly be required while the vehicle is in motion. IIDs must be installed on every vehicle the offender owns and operates. A person required to install an IID may not drive a vehicle that is not equipped with the device. Offenders who fail to install and use the device pursuant to court orders will have their driving privileges suspended for the maximum time period of the original suspension.

The cost of installation and all monthy fees for the device must be paid by the offender. In order to become eligible for an IID, a DUI offender must enroll in a Substance Abuse Treatment Program. Tampering, altering, bypassing or allowing another person to blow into the device, and driving a car without an IID are prohibited. Persosn caught tampering or attempting to circumvent an IID will be charged with a class C misdemeanor and upon conviction will have their driver's license suspended for one year.

Ignition Interlock Device Requirements in Connecticut

Persons arrested for DUI, 2nd degree manslaughter with a motor vehicle and 2nd degree assault with a motor vehicle may be required by the court to only operate vehicles equipped with an IID as a condition of bail release. Persons who wish to participate in the Pretrial Alcohol Education System may also be required to install an IID. Upon a second conviction for DUI in Connecticut, an IID may be required if the conviction is based solely on alcohol impairment. Such offenders must obtain an interlock permit for two years of a court ordered 3 year license suspension. A third DUI conviction requires a permanent DMV license revocation. Third time offenders may apply to the DMV for a hearing after 6 years of the revocation for a reversal or reduction of the revocation. If driving privileges are restored, an IID must be installed for 10 years as a condition of the reinstatement. Persons convicted of 2nd degree manslaughter or assault with a motor vehicle must install an IID for two years following a one year license revocation.
