Ignition Interlock Devices in Colorado DUI Cases

Colorado Ignition Interlock DeviceAn Ignition interlock device, or IID, is a handheld breath testing device that attaches to the ignition system of a vehicle. The device prohibits the vehicle's ignition from starting unless a sober breath sample (under .02) is given. Random periodic breath samples will be required while the vehicle is in motion. All breath results will be stored in the device and transmitted to the proper authorities. Persons who are caught driving a vehicle that is not equipped with a device will face further punishment, including the possible termination of their restricted license. The cost of the installation as well as the monthly payments must be paid for by the offender. Any person caught attempting to tamper or circumvent the device face additional penalties.

Any Colorado DUI offender who submits to a chemical test that reveals a BAC of .17 or more is required to install and drive with an ignition interlock device (IID) on their vehicle for a minimum period of two years following any criminal DUI conviction and administrative license revocation. First time DUI per se offenders who face a 9 month period of license revocation will be eligible for restricted driving privileges if an ignition interlock device is installed on their car. Second time DUI offenders will receive a one year suspension without any probationary driving privilege. Persons with 2 or more prior Colorado DUI/DWAI convictions face a two year license revocation with the possibility of ignition interlock restricted privileges after one year. During the period in which an IID is required, the person will carry what is called a "restricted license" that prohibits them from operating any vehicle without an IID device.
