Arkansas DWI Law Explained
Under Arkansas DWI/DUI law, there are two basic ways to be be charged, plus an additional provision for minors driving under the influence and vehicular homicide.
Arkansas DWI Law: Driving While Intoxicated
If a driver is intoxicated by either alcohol or a similar intoxicating substance, or else has a BAC of 0.08 or more, he or she can be charged with driving while intoxicated.

Arkansas Minor DWI: Underage Driving While Intoxicated
If an underage driver is intoxicated by either alcohol or a similar intoxicating substance, or else has a BAC of 0.02 or more, he or she can be charged with underage driving while intoxicated.

DWI Related Negligent Homicide In Arkansas
If a driver operates a motor vehicle while intoxicated and causes the death of another person under circumstances where a reasonable person would have understood that causing the death of another person was a significant risk, he or she can be charged with negligent homicide.
