Arkansas Ignition Interlock Laws

In Arkansas DUI cases, a driver who is convicted of a DWI offense will have his or her license suspended.

The court has the choice to use the full suspension term or to shorten it and issue the driver a restricted license which allows a driver to drive if he or she uses an ignition interlock device.

The court may also require any driver convicted of any DUI offense to use an interlock device for an additional year before allowing them to be eligible for a full driver's license. If the device is installed, the driver must have it checked and serviced every 67 days.

It is a criminal offense to attempt to start a vehicle equipped with an interlock device by bypassing the device, whether mechanically, chemically, or with a sober breath sample of another person. It is also a criminal offense for a person to provide a driver with a restricted license a vehicle without an interlock device if the person providing the vehicle knows or has reason to know about the driver's license restriction.
