In Arizona DUI cases, the basic laws, statutes and decisions are the same and apply to every case. However, your case must be approached in different ways depending on the local jurisdiction you are in. In Arizona, every county has its own Superior and Justice Court system. Nearly every major city and town in Arizona has its own municipal, city or town court. No two courts have exactly the same procedure. Furthermore, since different government agencies handle to prosecution in each court, how the case is pursued and what plea bargains are offered can differ drastically. As an example, a conviction for a 2nd offense super-extreme DUI in Scottsdale Municipal Court will result in 180 days of straight jail time, whereas the same conviction in Tempe Municipal Court will result in as little as 15 days in jail and 165 days of electronic home detention. |
