You have the right to plead not guilty

 

When you are charged with a DUI in Arizona, you have the rights to enter a plea of not guilty. Not only is this your right, but it is what most judges expect.

 

It follows that judges will not punish you for a exercising this important right.

 

I am frequently asked by people who are charged with DUI whether it  will be held against them if they plead not guilty at their arraignment or preliminary hearing. The answer, of course, is that it will not be held against them (except in certain circumstances regarding felony DUI, if a could offer made by the prosecutor's office will be withdrawn).

 

There are certain circumstances where it makes sense to enter a plea of guilty immediately.  This should usually only be done after full consultation with an experienced DUI defense attorney.
